1. Introduction and Acceptance
Welcome to Fix Land (collectively referred to as “Fix Land,” “we,” “our,” or “us”), a Canadian company offering professional landscaping, interlocking stone installation, retaining wall construction, window well waterproofing, demolition, and related outdoor improvement services. These Terms of Service (“Terms”) govern all access to and use of the Fix Land website (www.fixland.ca) and any related services, projects, or digital platforms (collectively, the “Services”).
By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Services. Fix Land reserves the right to modify these Terms at any time; continued use after changes constitutes acceptance.
2. Services and Projects
Fix Land provides landscaping, interlocking stone, retaining wall, window well waterproofing, demolition, and related outdoor improvement services for residential and commercial properties primarily in the Greater Toronto Area (including Toronto, Newmarket, Mississauga, and Brampton). We may engage subcontractors for specialized work, but all projects will be performed with due care and diligence.
Project timelines, costs, and scope will be confirmed in writing or by quotation before work begins. Estimates are approximate and subject to site conditions, material availability, and unforeseen circumstances.
3. Customer Obligations and Conduct
You agree to:
- Provide accurate information about your property and needs;
- Obtain any necessary permits, consents, or approvals;
- Maintain clear access to the work area;
- Respect neighbours and public property; and
- Not use the Services for illegal or unlawful purposes.
4. Intellectual Property
All content on www.fixland.ca, including text, images, logos, and project examples, is the exclusive property of Fix Land or its licensors. You may not reproduce, distribute, or use this content without prior written permission, except for personal, non-commercial viewing.
5. Limitation of Liability
To the fullest extent permitted by law, Fix Land’s total liability arising from the Services shall not exceed the amount you paid for the specific project. We are not liable for indirect, consequential, or incidental damages, including loss of profits, data, or business opportunities.
6. Insurance and Indemnity
You agree to indemnify and hold Fix Land harmless against any claims, damages, or losses arising from your breach of these Terms or your actions during a project. Fix Land maintains comprehensive general liability insurance; a certificate may be provided upon request.
7. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved exclusively in the courts located in the Greater Toronto Area, Ontario.
